JAMMU: Sessions Court has awarded life imprisonment to a Special Police Officer of Jammu and Kashmir Police for killing his colleague with his service rifle while on duty in Rajouri district.
Principal Sessions Judge Rajouri, Ashok Sharma awarded rigorous life imprisonment to SPO Mohammad Shakoor, resident of Rital, District Rajouri for killing his colleague Mohammad Ishaq, sources here today said.
“On February 1, 2005, the accused SPO who was performing ‘Sentry’ duty at the picket killed constable Mohammad Ishaq by firing at him with his official Self Loading Rifle following which a case under Section 302 of RPC was registered and investigations started,” sources said.
Principal Sessions Judge after hearing the prosecution observed that the accused killed his colleague by firing from his official SLR and the act was not instantaneous.
“From the facts of the case, it became clear that the accused nourished a grudge with him as the deceased had a tiff with him a day earlier and he slapped him,” court observed.
The court said it was not the rarest of the rare case, hence; extreme death penalty cannot be awarded to him and therefore, he was sentenced to rigorous life-imprisonment and a fine of Rs. 20,000, was stopped on him.
“In default of payment of fine he shall further undergo simple imprisonment for three months, which will be concurrent with life imprisonment,” said the court.
